TERMS & CONDITIONS

By booking, paying for, or attending any lesson or service with Noble Driving School (“NBS”, “we”, “our”, “us”), you agree to these Terms & Conditions.

1. Legal Compliance

Noble Driving School operates in accordance with:

  • Australian Consumer Law
  • VicRoads regulations
  • Road Safety Act 1986 (Vic)
  • Privacy Act 1988 (Cth)
  • Nothing in these Terms excludes or limits any consumer guarantees under Australian Consumer Law.

2. Instructor Accreditation & Vehicles

  • All instructors are fully licensed and accredited in Victoria.
  • All training vehicles are registered, roadworthy, insured, and fitted with dual controls.
  • Students must comply with all lawful instructions given by the instructor.
  • NBS reserves the right to substitute instructors or vehicles if required.

3. Student Eligibility & Responsibilities

Students must:

  • Hold a valid Learner Permit or Licence.
  • Carry their permit/licence at all times during lessons.
  • Disclose any medical conditions affecting driving ability.
  • Not be under the influence of alcohol or drugs.
  • If a student is deemed unsafe to drive, the lesson will be cancelled and charged as a late cancellation.

4. Bookings & Payments

  • All lessons must be prepaid unless otherwise agreed.
  • Package lessons are valid for 6 months from purchase date (unless otherwise stated).
  • Packages are non-transferable without written approval.
  • Prices may change without notice.
  • Refunds are subject to Australian Consumer Law.

5. Cancellations & No-Shows

  • Minimum 24 hours’ notice required.
  • Less than 24 hours = full lesson fee charged.
  • No-show = full lesson fee charged.
  • Medical emergencies may be considered at management discretion (evidence may be required).

6. Driving Test & Vehicle Hire Terms

  • Driving test packages may include:
  • Vehicle hire
  • Pick-up and drop-off
  • Pre-test lesson

Important:

  • Test results are determined solely by VicRoads.
  • NBS does not guarantee a pass.
  • If a student fails, standard lesson fees apply for further bookings.
  • Promotional discounts (e.g., re-test discounts) may be changed or withdrawn at any time.
  • If VicRoads cancels a test, rescheduling depends on availability.

7. Insurance & Liability

  • NBS vehicles carry comprehensive insurance.
  • Students are covered during lessons; however:
  • Students may be liable for insurance excess if damage results from unlawful, reckless, or deliberate conduct.
  • NBS is not responsible for personal belongings left in vehicles.
  • NBS is not liable for delays due to traffic, weather, or mechanical issues beyond reasonable control.
  • Liability is limited to the maximum extent permitted by law.

8. Safety & Behaviour Policy

NBS maintains zero tolerance for:

  • Aggressive behaviour
  • Harassment
  • Discrimination
  • Unsafe driving conduct
  • Lessons may be terminated immediately without refund if safety is compromised.

9. Privacy Policy

We collect personal information for:

  • Bookings
  • Test scheduling
  • Legal compliance
  • Information is stored securely and handled in accordance with the Privacy Act 1988 (Cth).
  • We do not sell personal information.

10. Refund Policy

Refunds will be provided where:

  • There is a major failure under Australian Consumer Law.
  • Services are not delivered as agreed.
  • Change-of-mind refunds are not guaranteed.

Unused package lessons may be refunded at management discretion, minus:

  • Used lessons charged at full rate
  • Administrative fee (if applicable)

11. Social Media & Photo Consent

From time to time, NBS may:

  • Take photos/videos of students (e.g., licence achievement photos).
  • Post content on social media platforms for marketing purposes.
  • By participating, students consent unless they provide written notice declining media use.
  • Students may withdraw consent at any time in writing.

12. CCTV & Dashcam Recording

For safety, insurance, and training purposes:

  • Lessons may be recorded via dashcam or CCTV.
  • Recordings may be used for insurance claims or legal compliance.
  • Footage will not be publicly shared without consent unless required by law.

13. Gift Voucher Terms

  • Gift vouchers are valid for 12 months from issue date.
  • Non-refundable and not redeemable for cash.
  • Lost vouchers will not be replaced unless proof of purchase is provided.

14. Student Progress Disclaimer

Learning to drive depends on:

  • Individual ability
  • Practice outside lessons
  • Compliance with instructor guidance
  • NBS does not guarantee that a student will pass a driving test within a specific number of lessons.

15. Workplace / Corporate Training Contracts

For corporate or fleet training:

  • Written agreement required.
  • Invoices payable within agreed terms (e.g., 7 or 14 days).
  • Late payments may incur administrative fees.

16. Defensive Driving Courses

Defensive driving courses:

  • Are educational in nature.
  • Do not replace legal licensing requirements.
  • May not reduce licence points unless approved by relevant authorities.

17. Force Majeure

NBS is not liable for cancellations or delays due to:

  • Severe weather
  • Government restrictions
  • Road closures
  • Vehicle breakdown beyond reasonable control

18. Amendments

  • NBS may update these Terms at any time. Updated versions will apply from date of publication.

19. Governing Law

  • These Terms are governed by the laws of Victoria, Australia.
